OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Any disputes arising under these Terms shall be resolved through binding arbitration administered in Panama City, Panama, in accordance with the rules of the Centro de Conciliacion y Arbitraje de Panama (CeCAP). The language of arbitration shall be English or Spanish, as agreed by the parties.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
The failure of the Company to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
